Andrew Cuomo, after being subpoenaed last month, has agreed to testify to Congress about his controversial nursing home advisory from the early days of the Covid-19 pandemic, Rep. Brad Wenstrup told CNN’s Jake Tapper on Friday. Cuomo has insisted that advisory was consistent with guidance from the Centers for Medicare and Medicaid Services and the Centers for Disease Control and Prevention. However, his upcoming appearance before lawmakers is a sign of continuing scrutiny over his handling of long-term care facilities during the pandemic. The voluntary agreement means that Cuomo will participate with a transcribed interview rather than a deposition. Wenstrup told Tapper on Friday that the panel will also hear from Cuomo’s former secretary Melissa DeRosa and former commissioner of the New York State Department of Health Dr. Howard Zucker.

Tech stocks are heavily exposed to China, which could put gains at risk, according to Piper Sandler. Tech companies are especially vulnerable to any weakness in China, with semiconductor businesses notably generating more than 30% of their sales in the country, the note read. In April, the VanEck Semiconductor ETF (SMH) has dropped about 7%, underperforming the S & P 500's more than 3% decline during the same period. "S & P large caps have near-record exposure to a China that is wobbly economically, with an increasingly authoritarian Heavy Hand of regulation," Lazar wrote Wednesday. S & P Global Ratings this week noted the country could be in for a new wave of bond defaults that could come as soon as next year, further fueling those worries.

"If somebody doesn't believe Tesla's going to solve autonomy, I think they should not be an investor in the company," Musk said on the earnings call. In a shareholder deck that Tesla published before the call, the company featured a "preview of ride-hailing in the Tesla app." At an AI Day in August 2021, Musk said Tesla would build a humanoid robot, now known as Optimus. "No matter what, even if I got kidnapped by aliens tomorrow, Tesla will solve autonomy, maybe a little slower but it would solve autonomy for vehicles at least," Musk said.

FTC bans employers from using noncompete clauses

New York CNN —The Federal Trade Commission on Tuesday voted to ban for-profit US employers from making employees sign agreements with noncompete clauses. And – with one exception – it makes currently existing noncompete agreements unenforceable after the rule’s effective date, which is set at 120 days from the rule’s publication in the Federal Register. The rule, however, does allow currently existing noncompete agreements for senior executives to remain in force. The ban would apply nationwide, overriding state laws regarding noncompete agreements. In December of last year, New York State Governor Kathleen Hochul vetoed a bill passed by the state legislature to completely ban noncompete agreements in that state.

The CMO role at several companies, including Walgreens, Uber, and Starbucks, has been eliminated. A 2023 McKinsey report found that 40% of Fortune 500 companies don't have a CMO or another growth- or customer-related position in their CEO's executive committee. But role models like Rare Beauty's CMO, Katie Welch, offer young marketers hope for the profession's future. "Businesses that are eliminating the CMO role or pulling it into something else, the leadership in those companies don't see the value of marketing," she said. As many American companies struggle to navigate the world's second-largest economy, Meta Platforms has found itself raking in billions of dollars from China without the direct challenges of doing business there. The influx in spending from Chinese ecommerce advertisers has been a "significant positive" for Meta, said Rohit Kulkarni, analyst at Roth MKM covering internet companies. Many American companies doing business in China have battled similar challenges as the post-Covid recovery there has progressed slower than expected. Meta has said it has a "diverse advertiser base" of Chinese companies. The concern is that as more Chinese advertisers target American consumers through Meta's platforms, that could drive up the price of ads for everyone.

Wall Street anticipates a largely rosy setup for the stock, with many forecasting that the company beats, or reports in line with expectations. The anticipation contributed to some Wall Street firms lifting their price targets heading into the print. Planet Fitness announced Tuesday that Colleen Keating will take over as the fitness club's new CEO, effective June 10. Craig Benson, who has been serving as interim CEO since the departure of Chris Rondeau in September, will remain on the board of directors. The announcement comes after months of searching, and some analysts are calling it a positive for the stock, despite shares falling more than 3% following the announcement. The oil market has brushed off Iran's weekend air assault against Israel, with futures trading as much as 1.5% lower on Monday. Oil prices could spike above $100 a barrel depending on how Israel responds to the attack, the analyst wrote. Attack 'well-telegraphed' Iran's attack, though unprecedented, did little actual damage as Israel and the U.S. intercepted nearly all the drones and missiles. The Islamic Republic warned, however, it would strike harder next time if Israel responds to the weekend attack. Potential threats include Iran seizing ships associated with Israel in the Strait of Hormuz; Israel attacking Iranian oil and gas assets; or Iran striking energy assets of its neighbors if Israel hits too hard.
